Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records of the second respondent made in AX-TNGOVT communicated to the petitioner's mobile No.8940545301 on 03.05.2025 at 6.23 PM, quash the same and consequentially direct the second respondent to survey the lands in S.F.Nos.266/5B1B 0-5.27 Ares (13 cents) and 266/5C1A1B 0-0.81 Ares (2 cents) as per Patta No.4690 situated at Thandalam Village.

ORDER

The relief sought for in this writ petition is to call for the records of the second respondent made in AX-TNGOVT communicated to the petitioner's mobile No.8940545301 on 03.05.2025 at 6.23 PM, quash the same and consequentially direct the second respondent to survey the lands in S.F.Nos.266/5B1B 0-5.27 Ares (13 cents) and 266/5C1A1B 00.81 Ares (2 cents) as per Patta No.4690 situated at Thandalam Village.

2. Mr.D.Ravichander, learned Special Government Pleader takes notice on behalf of the respondents 1 & 2. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.

3. Learned counsel for the petitioner would submit that the petitioner and one Mr.V.Venkatesan jointly purchased the properties having an extent of 15 cents in S.F.Nos.266/5B (13 cents) and 266/5C1A1 (2 cents) situated at Thandalam Village, Arakkonam Taluk 2/6

with specific boundaries and patta was also mutated in their names. The third respondent had purchased lands at Thandalam Village in Old S.F.No.(266/5C1) 266/5C1A, New S.F.No.266/5C1A1 having an extent of 0.08.71 Ares (11.25 cents) out of 21.50 cents. Therefore, on 07.01.2025, the petitioner applied online for survey of their lands along with necessary charges. Without surveying the lands, the second respondent rejected the petitioner's online application vide order dated 03.05.2025 on the ground that there was no sub-division and patta was also not stands on their name. Though the petitioner has produced a copy of the patta and the sub-division made on the property in S.F.No.266/5C1A1B, the second respondent has not passed any order. Under these circumstances, the third respondent put up a fencing by including portion of petitioner's land. Hence, the petitioner has come forward with the present writ petition.

4. After getting written instruction, learned Special Government Pleader appearing for the respondents 1 & 2 would submit that the 3/6

second respondent has intended to survey the petitioner's land and fixed the date of survey on 01.10.2025 at 11.00 A.M and in this regard a proceeding has also been issued vide Na.Ka.Aa1/3335/2025, dated 28.09.2025.

5. Heard the learned counsel on either side and perused the materials available on record.

6. Since, the second respondent has already issued the proceedings and fixed the date for survey as 01.10.2025, this Court is inclined to set aside the impugned order dated 03.05.2025. Accordingly, the same is set aside. Consequently, this Court directs the respondents 1 & 2 to conduct a survey and demarcate the petitioner's property, after giving due notice and opportunity of personal hearing to the petitioner as well as the third respondent and aggrieved persons, if any, within a period of three weeks from the date of receipt of a copy of this order. It is needless to say, in case of any obstruction being created by third parties, the second respondent is at liberty to approach the Police officials, in which case, the Police officials shall render assistance to the second respondent to 4/6

carry out the aforesaid exercise.

7. With the aforesaid direction, this writ petition is disposed of. No costs.
