ORDER

This petition has been filed to quash the FIR filed for the offences under Sections 24(1) COTPA Act and 123 of BNS Act, 2023 on the file of the respondent Police.

2. It is the case of the prosecution that when the respondent Police proceeded to a shop named "Tea Point", the petitioner attempted to flee. During search, tobacco products were seized from the said shop and the same were handed over to the Police.

3. Heard both sides and perused the materials available on record.

4. Considering the submissions of both sides, it is clear that banned tobacco products were seized from the petitioner's Shop and an FIR came to registered against the petitioner and now investigation is pending.

5. In such view of the matter, at this stage, I do not find any merit in this petition to quash the FIR. Accordingly, this petition is dismissed. Consequently, connected miscellaneous petition is closed. However, the respondent shall file final report expeditiously.
