This Criminal Original Petition has been filed to quash the final in S.C.No.22 of 2018 pending on the file of learned Principal District and Sessions Judge, Kancheepuram on the ground that the witnesses examined by the prosecution have not properly implicated the petitioner. 1/4
2. Admittedly the prosecution has examined 14 witnesses i.e. P.W.1 to P.W.14 in the case filed against the petitioner for the offences under Sections 498A and 306 IPC. Now the petitioner wants this Court to act as an appellate Court and to ascertain the veracity of the evidence of the witnesses which already came on record and to give findings to quash the entire Sessions Case which is nothing but a clear abuse of process of law. 3.
Once the witnesses were already examined by the trial Court, it is for the trial Court to appreciate the entire evidence and to find out as to whether the charges are made out against the accused or not. At the outset, this Court finds no merits in this petition.
