... Respondents/ Respondents This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.V.Velu, learned counsel for the appellant claimant and Mrs.R.Sree Vidhya, learned counsel for the second respondent/insurance company present. There is no representation for the first respondent. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.26,86,600/-, along with interest at 7.5% per annum, from the date of filing of the claim petition i.e., 02.11.2016, till the realization. Aggrieved by the award of the Tribunal, the appellant/ claimant had preferred the present appeal. 2.After due deliberation and consultation, both the parties have agreed to settle the award to a sum of Rs.9,50,000/- (Rupees Nine Lakh and Five Thousand Only), in full quit.
4.The second respondent/ insurance company is directed to deposit the amount of Rs.9,50,000/- (Rupees Nine Lakh and Five Thousand Only), excluding the amount already deposited, if any, within a period of six weeks from the date of receipt of a copy of this order, to the credit of M.C.O.P.No.6697 of 2016 on the file of the Motor Accident Claims Tribunal, III Court of Small Causes, Chennai. 5.The Tribunal is directed to transfer the above said award amount to the Bank account of the appellant/ claimant by way of NEFT / RTGS, on proper identification, in accordance with the terms of the award, without insisting on any formal permission petition.
