ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case in C.C.No.32 of 2018 was taken on the file of the Judicial Magistrate, Sathyamangalam Taluk, Erode for the alleged offence under Sections 21(d)(e)(f) of Tamil Nadu Forest Act, 1882 read with 36(a) and 36(2) of Tamil Nadu Sandalwood Possession Rules, 1979. The occurrence is of the year 2015. The allegation in this case is that the accused was found to be in possession of 6 1⁄2 Kgs of Sandalwood. It is stated that the sandalwood involved in this case is not traceable. It is also reported that the accused has been attending the Court regularly. There is no previous or subsequent previous case against the accused.

3.Considering the quantum of sandalwood involved and the fact that the accused is a first-time offender, one more opportunity is given to the accused, who has also been facing trial since 2015, any further continuation of the trial would impinge upon his right to a speedy trial of the accused and no useful purpose would be served.

4.Accordingly, the case in C.C.No.32 of 2018 of Judicial Magistrate Sathyamangalam Taluk, Erode, stands quashed. This Suo Motu Transfer Case is disposed of.

10.10.2025 mp electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
