The petitioner, who apprehends arrest for the alleged offence under Sections 166, 167, 420 and 120B of IPC in Cr.No.1 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant one Mr.Raja, Regional Manager, TNCSC, Vellore has lodged a complaint before the respondent police stating that some of the TNCSC Vellore Regional Office Officers and staffs relating to paddy procurement has colluded with other individuals and used the TNCSC direct paddy procurement centers in and around Vellore district and procured huge amount of paddies from individuals without following the guidelines laid by the Government and obtained the incentives which is allotted for the benefits of the farmers for their produce and enjoyed the same with the help of individuals and also caused huge loss to the Government. Hence the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence prays for grant of anticipatory bail.

The learned Government Advocate (Crl.Side) submitted that the prosecution case is purely against the Government officers and staffs who are all involved in fake paddy procurements in the name of farmers without following the guidelines laid by the Government during the year 2020-21 through TNCSC direct paddy procurement centers. He further submitted that more than 200 merchants have been involved in this case and 15 merchants have been arrested and this petitioner is one of the merchant and still receiving complaints and the case is under investigation. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and the gravity of offence committed by the petitioner, this court is not inclined to grant anticipatory bail to the petitioner.
