The petitioners, who were arrested and remanded to judicial custody on 25.11.2022 for the alleged offence under Sections 273, 328 IPC and Section 7, 20(1) of Cigarette and Other Tobacco Products Act and Section 58, 29 of Food Safety and Standards Act, 2006 in Cr.No.364 of 2022, seek bail.

2.The case of the prosecution is that the petitioners along with other accused were found in possession of 373 Kgs of banned tobacco products. Hence, the case.

3.The learned counsel appearing for the petitioner would submit that the petitioners have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. He would further submit that the first petitioner is the owner of the vehicle. Further, that the petitioners are in custody from 25.11.2022. Hence prays for grant bail to the petitioners.

anu 4.The learned Government Advocate (Crl.Side) would submit that the petitioners along with other accused were found in possession of 373 Kgs of banned tobacco products. He would submit that the petitioners belonging to the State of Karnataka and if they are released on bail, they would abscond. Hence, he vehemently opposed to grant bail to the petitioners.

5. Considering the gravity of offence committed by the petitioner and that since they belong to the State of Karnataka, they may abscond if they are released on bail, this court is not inclined to grant bail to the petitioner.
