2. The cases in C.C.Nos.1031 of 2024, 1200075 of 2018 & 1200885 of 2011 of Judicial Magistrate Court No.V, Puducherry Taluk, Puducherry, are registered for alleged offences under Sections 279 and 304(A) of IPC and 279, 338 and 304(A) of IPC & 146 r/w 196 of MV Act and 279, 304(A) & 214(1) of PMVR r/w 177 of MV Act respectively. It is stated that both the accused and the defacto complainant are not traceable. However, non-bailable warrant is pending against the accused in these cases. Considering the factual matrix, context of the case, the antecedents of the accused, the reason for absence from their usual place, and the submission that, despite best efforts, the warrants could not be executed, it is evident that even if the accused are brought to face trial, it would impinge upon their right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.
4. Accordingly, the cases in C.C.Nos.1031 of 2024, 1200075 of 2018 & 1200885 of 2011 on the file of the Judicial Magistrate Court No.V, Puducherry Taluk, Puducherry, shall stand quashed and this Suo Motu Transfer Cases stand disposed of.
06.10.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
