Respondents Prayer : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the second respondent to consider the petitioner representation dated 20.4.2017 subsequently direct the second respondent to removing the encroachment put forth by the third respondent in Block No.20, Ward No.7, Town Survey No.4 24/2, 25, 26 and 27 Sakthi Nagar Kudiyiruppu Manai Pirii (Ma.Pa/6 (se.tha) No 86/86 to an extent of

7185 sq. ft. and subsequently setting up a Corporation public park in the said place.

ORDER

(Order of the court was made by the Hon'ble Chief Justice) We have heard Mr.M.Subash, learned counsel for the petitioner; Mrs.R.Anitha, learned Special Government Pleader for the first respondent; and, Mrs.Devi for the second respondent.

2. Encroachment on the park is alleged.

3. Learned counsel for the Corporation submits that now the Corporation has taken steps for removal of the encroachment on the park. The patta in respect of the said land earmarked for park stands in the name of the Corporation.

4. Learned counsel for the Corporation further submits that notice has been issued to the encroacher on 29.9.2023 and further process would be undertaken in accordance with law.

5. In view of the aforesaid statement made by learned counsel for the respondent Corporation, the writ petition stands disposed of. There will be no order as to costs.
