The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 406 and 420 of IPC in Crime No.411 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused persons collected a sum of Rs.11,000/- to arrange a loan for a sum of Rs.1,00,000/-. However, neither they arranged the loan nor repaid the above said Rs,11,000/-. Hence, the case. 3.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution. He further submitted that A1 had been running the company without knowledge of the petitioner, A1 had directly collected money from the informant and cheated her. So that, A1 was arrested and remanded to Judicial Custody. Subsequently, A1 was enlarged on bail before Principal Sessions Judge at Chennai in Crl.M.P.No.22139 of 2022 dated 16.11.2022. Hence, he prayed for Anticipatory Bail to the Petitioner.

4.The learned counsel appearing on behalf of the Intervenor raised objection stating that the petitioner was a Managing Director of the disputed Company and he further submitted that the petitioner who had cheated near about Rs.40,00,000/- from the public. Hence, he opposed for grant of Anticipatory Bail to the petitioner.

5.The learned Government Advocate (Crl.Side) submitted that petitioner is A2/MD of the Company, A1 and A3, who are CEO and Director of the Company. He further submitted that petitioner and co-accused had cheated general public to the tune of Rs.40,00,000/-. Hence, he opposed for grant of Anticipatory Bail to the petitioner. 6.Considering the fact that there is huge amount of public money involved in this case, this Court is not inclined to grant anticipatory bail to the petitioner.

7.Accordingly, this Criminal Original Petition stands dismissed. 02.02.2023 dk
