PRAYER:- The Habeas Corpus Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Habeas Corpus directing the respondents 1 and 2 to produce the minor child namely, Tanvi, aged 5 years, D/o.E.Manigandan before this Court from the custody of 3 rd respondent and handover to the petitioner.

ORDER

(Order of the Court was made by J.NISHA BANU, J.) The present Habeas Corpus Petition is filed to direct the respondents 1 and 2 to produce a minor child namely, Tanvi, aged 5 years, D/o.E.Manigandan/petitioner herein before this Court from the custody of 3 rd respondent/wife and handover to the petitioner.

2. When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for respondent Nos.1 and 2 submitted that it is a matrimonial dispute between the petitioner and the third respondent. It is further submitted that the petition filed by the petitioner for divorce and the petition filed by the third respondent for restitution of conjugal rights are pending.

3. If at all the petitioner is aggrieved, he is at liberty to file a petition before the appropriate forum seeking custody of the minor child. Accordingly, the Habeas Corpus Petition stands dismissed.
