Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the third respondent to cancel the patta inadvertently issued in the name of 5th respondent relating to property comprised in Old Survey No.916/P, New Survey No.91, Plot No.7, 1/4

situate at Boganapalli Village, Krishnagir Taluk & District admeasuring an extent of 2800 sq.ft. including 74 sq.fts of RCC building and restore the same in the name of petitioner being the original owner, considering petitioner's representation dated 22.07.2024 within the time frame to be fixed by this Court.

ORDER

This Writ Petition has been filed seeking a direction to the third respondent to cancel the patta issued in favour of the fifth respondent in respect of the property comprised in Survey No.916/P, New Survey No.91, Plot No.7, measuring an extent of 2800 sq.ft, situated at Boganapalli Village, Krishnagiri Taluk, based on the representation submitted by the petitioner dated 22.07.2024.

Heard the learned counsel appearing on either side and perused the materials available on record.

Without expressing any opinion on the merits of the writ petition, the third respondent is directed to consider the representation 2/4

submitted by the petitioner seeking cancellation of the patta issued in favour of the fifth respondent, after conducting an enquiry and after giving an opportunity of hearing to the petitioner as well as the fifth respondent, and dispose of the same on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. 4.

With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
