ORDER

This Criminal Original Petition has been filed to call for the records pertaining to the Crime No.275/2024 on the file of Station House Officer, Ariyankuppam, PS, Puducherry against the petitioners and to quash the same.

2. Heard the learned counsel for the petitioners and the learned Public Prosecutor (Pudhucherry) appearing for the first respondent-Police and perused the materials available on record.

3. F.I.R in Crime No.275 of 2024 has been registered by the respondentPolice for the offences under Sections 420, 468, 406, 471 and 34 of the IPC as against the accused persons. The petitioner seeks to quash the F.I.R as against the petitioners who are arrayed A2 & A3 on the ground that there is no specific overt act as against the petitioners. The allegation as against the petitioners is that the petitioners and other accused played deception on the de-facto 2/4

complainant and sold the land by receiving a sum of Rs. 1,47,50,000/-. The mere allegation of deception is very much available.

4. The learned Public Prosecutor, (Pudhucherry) appearing for the first respondent-Police submitted that investigation has almost completed and final report will be filed within a period of two weeks.

5. In view of above, this Court is not inclined to quash the said F.I.R at this stage. Hence, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed.
