Nos.26/A and 27/1A in Errahalli Village and for the land measuring 0.68 1/2 Cents in S.F. No.528/1 in Kaveripattinam-II Village, Krishnagiri Taluk and District and quash the same as illegal.

ORDER

The present Writ Petition has been filed challenging the issuance of Patta Nos. 3135 and 4768 dated 27.07.2025, by the 1st respondent in favour of the 2nd respondent.

2. The main grievance of the petitioner is that the 2nd respondent's initial application before the 1st respondent for the issuance of a patta was rejected. Subsequently, the 2nd respondent filed a fresh application, which was considered, and the impugned pattas were issued. Aggrieved by the issuance of the pattas in favour of the 2nd respondent, the petitioner has filed the present writ petition.

3. The learned counsel appearing for the 2nd respondent submits that although the 2nd respondent's initial request for the issuance of a patta was rejected, a subsequent application was preferred along with relevant

documents. The 1st respondent, upon being satisfied with the documents produced, issued the pattas to the 2nd respondent. He further contends that the petitioner has an alternative remedy to file an appeal before the competent appellate authority.

4. The learned Government Counsel submits that an efficacious statutory remedy of appeal is available to the petitioner under Section 12 of the Tamil Nadu Patta Pass Book Act, 1983.

5. This Court finds force in the contentions raised by the learned counsel for the 2nd respondent as well as the learned Government Counsel.

6. In the present case, patta has been issued in favour of the 2nd respondent. The petitioner has an effective alternative statutory remedy by way of an appeal in terms of provision of Section 12 of the Tamil Nadu Patta Pass Book Act. However, without exhausting the said statutory remedy, the petitioner has directly approached this Court by filing the present Writ Petition.

7. In view of the availability of an alternative and efficacious statutory remedy, the relief sought by the petitioner cannot be granted in this Writ Petition. Accordingly, this Writ Petition is dismissed. However, liberty is granted to the petitioner to file a statutory appeal before the appropriate appellate authority under Section 12 of the Tamil Nadu Patta Pass Book Act, 1983, within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
