PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the first respondent to dispose the appeal filed by the petitioner against the order of the second respondent by his proceedings Mu.Mu.952/2023 A1 dated 12.7.2023 and 17.8.2023 on merits and in accordance with law and after affording an opportunity of hearing to the petitioner. ORDER

Aggrieved by the fact that his appeal preferred on 23.8.2023 to the first respondent challenging the deletion of his name from the patta has not been inquired into till date, the petitioner is before this Court.

2. Heard the learned counsel appearing on behalf of the petitioner and the learned Additional Government Pleader accepting notice for respondents 1 to 3.

3. Considering the limited nature of the prayer sought for, this Court does not intend recounting the facts that have preceded filing of this writ petition. Suffice it to state that the first respondent, who is the Statutory Authority, before whom, the appeal is pending, has not taken steps to dispose of the same.

4. Accordingly, the writ petition is allowed and a Mandamus is issued to the first respondent to consider and pass orders on the appeal filed by the petitioner on 23.8.2023 within a period of six weeks from the date of receipt of a copy of this order. No costs. 2/3
