The present Writ Petition has been filed seeking a direction to the 6th respondent herein to de-freeze the bank account of the petitioner bearing A/c No.42111551818 so as to enable the petitioner to operate his account.
2. It is the case of the petitioner that her bank account has been frozen by the sixth respondent bank in reference to the communication received from the Cyber Crime Police, Delhi and Bazarpet PS, Thane, stating that the petitioner has received a sum of Rs.1,302/- on 15.03.2025 and Rs.4,950/- on 17.04.2025 to his account. Therefore, the petitioner sent a representation through an e-mail to the 2/5
6th respondent on 18.08.2025 requesting to de-freeze her bank account. However, the same has not been considered so far. Hence, the present Writ Petition.
3. The learned counsel for the petitioner submits that no notice was issued to the petitioner prior to the freezing of her bank account in order to put forth her explanation. However, it would suffice if this Court issues a direction to the 6th respondent to consider the petitioner's representation so as to enable the petitioner to enable her bank account.
4. Considering the aforesaid submissions, this Court without expressing any opinion on the merits of the case, directs the 6th respondent to consider the petitioner's representation/e-mail dated 18.08.2025 on merits and pass appropriate orders in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order after affording an opportunity of hearing to the petitioner. No costs.
