ORDER

This Criminal Original Petition has been filed to call for the records and to quash the proceedings in J.C.NO.21 of 2021 on the file of the Juvenile Justice Board, Erode by recording the joint compromise entered into between the petitioner/accused and second respondent/victim.

2. Heard the learned counsel for the petitioner/accused, the learned counsel for the second respondent/victim and the learned Additional Public Prosecutor appearing for the first respondent-Police and perused the materials available on record.

3. The learned Additional Public Prosecutor appearing for the first respondent-Police submitted that the petitioner was charged for the offences under Sections 5(l), 6 and 5(j)(ii) of POCSO Act and Section 376(3) of the IPC. At the time of alleged occurrence, the victim was aged about 15 years. Evidences have already been recorded and J.C.No.21 of 2021 is pending on the file of the Juvenile Justice Board, Erode.

4. In view of the above submission and also considering the nature of offence, this Court is not inclined to quash the said criminal proceedings at this stage. The Juvenile Justice Board, Erode is directed to take note of the reality and romantic relationship between the petitioner/accused and the victim and dispose of the proceedings in J.C.No.21 of 2021 in accordance with law.

5. With the abovesaid direction, this Criminal Original Petition is dismissed.
