C.M.P.No.27093 of 2024 in A.S.No.195 of 2022 A.S.No.195 of 2022 a n d C.M.P.No.27093 of 2024 Dr.G.JAYACHANDRAN,J This application is filed to implead the proposed parties as respondents 7 and 8 in the pending appeal, on the ground that the suit filed for partition by the appellant was dismissed on 30/4/2019 and thereafter, property was sold to M/s.Siivaganapathi Spinners Pvt. Ltd., and in turn M/s.Siivaganapathi Spinners Pvt. Ltd., sold the property to the petitioners. Thereafter, appeal filed by the plaintiffs was numbered as A.S.No.195 of 2022 and therefore, they are necessary parties. However, title document relied by the petitioners reveal that property was initially dealt by the defendants, pending suit and the property was changing from hand to hand for more than five times between 2007 and 2022. Thus, the predecessor in title of the petitioners is a purchaser pendente lite. Anyhow, interest of the petitioners being involved in this matter and hence, the application to implead is allowed.
