ORDER

Challenging the First Information Report registered in Crime No.344 of 2025 on the file of the respondent for the offences under sections 8[c], 20[b][ii][A], 25 and 29[1] of the Narcotic Drugs and Psychotropic Substances Act, 1985, the present Criminal Original Petition has been filed.

2. The petitioner is arrayed as A4 in this case. The case of the prosecution is that on 19.12.2024 at about 10.50 a.m., the first and second accused were found in illegal possession of 14.06 grams of OG Ganja and on the basis of their confession, the petitioner and other accused have been arrayed as accused in this case. It is the further case of the prosecution that the along with contraband, the mobile phones and a motorcycle have been seized from the accused. According to the petitioner, no seizure has been effected from him and he had been implicated in this case based on the confession of the co accused. Hence, seeks to quash the First Information Report against the petitioner.

3. The main contention of the petitioner is that no contraband has been seized from him. That cannot be ground to quash the First Information Report against the petitioner. The involvement of the accused can be unearthed only at the time of investigation and thereafter, during trial. Hence, at this stage this Court is not inclined to quash the First Information Report.
