Arul @ Tamiloli v. The Inspector Of Police

2023-11-10Honourable Mr Justice C.V. Karthikeyan2 pages

Crl.MP.No.17867 of 2023 in Crl.OP.No.14285 of 2023 C.V.KARTHIKEYAN , J.

This petition has been filed seeking extension of time to file sureties. 2.It is seen from records that in Crl.OP.No.14285 of 2023, a learned Single Judge of this Court had granted anticipatory bail to the petitioner herein even though a non bailable warrant had been issued against the petitioner. It is only proper that the petitioner appears before the trial Court and files an application to recall the warrant. The only protection given by this Court is that for that particular application to recall warrant provided records are available, should be disposed on the same day, and if records are not available, immediately thereafter. But it would always be advisable that the petitioner surrenders at 10.30 a.m. The Magistrate can then pass an order in accordance with the earlier direction of the Court granting anticipatory bail to the petitioner herein. Time is extended for compliance a further period of two weeks from the date of receipt of copy of the order.

3.Accordingly, this petition is ordered.
