John Bosco v. Doris Sampelo Selvaraj
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED : 11.12.2024 CORAM :
THE HON'BLE MR.JUSTICE V.LAKSHMINARAYANAN John Bosco .. Petitioner
Versus
Doris Sampelo Selvaraj .. Respondent Prayer: Civil Revision Petition filed under Article 227 of the Constitution of India to direct the Family Court, Thiruvallur to dispose of IDOP.No.305 of 2022.
For Petitioner : Mr.K.Chandrasekaran
ORDER
This civil revision petition seeks for expeditious disposal of IDOP.No.305 of 2022 on the file of the Family Court at Thiruvallur.
2. When the matter came up for admission, I asked a report from the learned Family Judge, Thiruvallur as to how long it will require to dispose the HMOP. I passed that order on account of the fact that the 1/4
respondent/wife had sent a certificate from the Department of Foreign Affairs at Phillipines together with a certificate saying that she is not going to oppose the divorce petition.
3. The learned Judge has sent a report on 27.11.2024 stating that originally the wife was residing in Maldives and thereafter, she has shifted her residence to Phillipines. The court had ordered notice to the Phillipines address, but the same has not been returned so far. The court also points out that on several dates, namely, 14.06.2024, 12.07.2024, 26.07.2024 and 10.10.2024, there has not been any representation on the side of the petitioner. Considering the non-receipt of the notice, the learned Judge is proposed to send a reminder to Indian Embassy at Phillipines for clarification on the service of summons.
4. The learned counsel for the petitioner points out that the wife is willing to appear through video conferencing. He states that he has filed an application to that effect and the same had been returned by the Court. 2/4
5. The learned judge is requested to take all steps necessary to ensure the proceedings attain finality on or before 25.04.2025.
6. With the above direction, this civil revision petition is ordered. No costs.
