Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, to call for the records of the second respondent's communication dated 02.07.2025 in Na.Ka.Pani 4 (4)/01/30/344/2022, quash the same, and consequently treat the petitioners as regularly promoted Senior Revenue Inspectors for the year 2022-23 through approved promotion panel against the validly estimated vacancies for the said year and pass orders.

Mr.R.U.Dinesh Raj Kumar, learned Additional Government Pleader accepts notice on behalf of the Respondents. With consent of the learned counsels on either side, the writ petition is taken up for final disposal.

This Writ Petition has been filed to call for the records of the second respondent's communication dated 02.07.2025 in Na.Ka.Pani 4 (4)/01/30/344/2022 and treat the petitioners as regularly promoted Senior Revenue Inspectors for the year 2022-23 through approved promotion panel against the validly estimated vacancies for the said year. 2/6

3. The case of the petitioner is that when they have been validly promoted against the available vacancies, their promotion is now questioned on the basis of the estimated vacancies. It is also the contention of the learned counsel for the petitioner that the vacancies estimated, based on which, the petitioners were promoted are correct and they did not require any change. The petitioners have challenged the communication of the second respondent dated 02.07.2025 by way of this petition.

4. Heard the learned counsel for the petitioners and the learned Additional Government Pleader for the respondents.

It is an admitted fact that for the communication dated 02.07.2025, the petitioners have also forwarded their representations to the second respondent seeking to approve the promotion panel of the petitioners. The alleged impugned proceeding dated 02.07.2025 is the communication to call for the particulars from the District Collector. Even before the particulars were published, the petitioners rushed to the Court. The petitioners have no case to challenge the proceedings dated 02.07.2025. However, taking into 3/6

consideration that the petitioners have forwarded their representations to the second respondent dated 28.07.2025, this Court is of the opinion that it is suffice to dispose the Writ Petition with a direction to the second respondent to consider and pass orders on the representation of the petitioners dated 28.07.2025 in accordance with law, on its own merits, within a period of four weeks from the date of receipt of copy of this order.
