The above Transfer Civil Miscellaneous Petition is filed seeking to withdraw IDOP.No.310/2023 pending on the file of the Principal District and Sessions Court, Thiruvallur and transfer the same to the file of the Principal District and Sessions Court, Mayiladuthurai.
2. IDOP.No.310 of 2023 has been filed by the respondent/husband seeking restoration of conjugal rights. The petitioner/wife had filed M.C.No.10 of 2023, on the file of the Judicial Magistrate No.1, Mayiladuthurai and had also filed DVC.No.31 of 2023 on the file of the Chief Judicial Magistrate No.1, Mayiladuthurai.
3. The learned counsel for the petitioner would submit that the petitioner/wife has withdrawn MC.No.10 of 2023. However, the DVC proceedings are still pending on the file of the Chief Judicial Magistrate No.1, Mayiladuthurai and the respondent/husband is appearing in the said proceedings.

Considering the fact that the respondent/husband is appearing before the Chief Judicial Magistrate No.1, Mayiladuthurai and contesting proceedings in DVC.No.31 of 2023, this Transfer Civil Miscellaneous Petition is allowed and IDOP.No.310 of 2023 pending on the file of the Principal District and Sessions Court, Thiruvallur is withdrawn and transferred to the file of the Principal District and Sessions Court, Mayiladuthurai. No costs. Consequently, the connected Miscellaneous Petition is closed.
