Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 2nd respondent to consider the petitioner's representation dated 26.10.2024 and to release the balance amount of Rs.5,64,000/-.
For Petitioner .. Mr.N.Kumar Rajan For R1 .. Mr.N.Naveen Kumar, Govt. Advocate
ORDER
This Writ Petition has been filed in the nature of a Mandamus seeking a direction to the respondents to examine the representation given by the petitioner and to release the balance amount of Rs.5,64,000/-. 2.In the affidavit filed in support of the writ petition, it had been stated that the petitioner is running a small garments centre, registered with MSME. On the basis of the registration, the petitioner had been recognized by the Tamil Nadu Skill Development Corporation to give training to the students. The Government extends grant to the petitioner, and in turn the petitioner is expected to forward that particular grant to the students.
3.On the date of inspection, there were no students available as declared by the petitioner. It is under those circumstances that the grant was withdrawn. The petitioner had given a representation seeking to restore the grant. That representation had been considered by an order dated 13.12.2024 by the respondents. Since the representation has been considered, it would only be appropriate that the petitioner challenges that order if it is adverse to them in appropriate manner, but a Mandamus would no longer lie. Accordingly, this Writ Petition stands disposed of granting that liberty to the petitioner. No costs.
