This Application has been filed seeking permission to file additional documents as income tax returns for the years 2012 - 13 and 2013 - 14 and gold purchase bills.
2.It is contended on behalf of the applicant that the documents are required during the course of trial.
3.A counter affidavit had been filed on behalf of the respondent stating that this application has been filed only to protract the proceedings and that the documents had been produced after eight years. 4.Heard the learned counsels.

5.Taking into consideration all facts and to give an opportunity to the petitioner to produce documents to put up his defence, the documents are permitted to be produced subject to proof, relevancy and admissibility. Accordingly, this application stands allowed. But however, this being the second instance, when the petitioner has to come to this Court, earlier being to set aside an exparte order, costs of Rs.10,000/- are imposed to be paid directly to the office of the Official Assignee within a period of three weeks.
