The petitioner/A2 seeks bail in Crime No.21 of 2023, registered by the respondent police for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C) of NDPS Act. The petitioner had been taken into custody on 10.08.2023.

2.The learned counsel for the petitioner states that the respondent had searched a train at Katpadi Railway Station and found that A1 was in possession of 20.400 kgs of ganja. That is commercial quantity. It is however stated that no recovery had been made from the petitionerA2 herein and therefore, the learned counsel states that the petitioner is innocent of all the offences.

3.Counter affidavit had been filed by the respondent, wherein it is stated that on confession of A1, the respondent had moved over to this petitioner, who is from Kerala. It is further stated that A1 used to purchase the said ganja from Andhra Pradesh and sell it to A2 in Kerala. Thereafter, the respondent had made further investigation and collected

the call records of A1 and A2 and found that they in regular contact with yet another person at Andhra Pradesh, who had been arrested in Visagapatnam.

4.It had been stated that all the three of them had continuous conversations. These are issues for trial, but since further investigation will have to be done with respect to the entire aspect, at this stage, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
