The petitioners, who apprehend arrest for the alleged offence under Sections 294(b), 323, 324 and 506(1) IPC in Cr.No.548 of 2020 on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution as per the defacto complainant is that the first petitioner picked up quarrel with the defacto complainant and abused him in filthy language and claims that he also holds a share in the complainant's property. Further, the petitioners abused and assaulted the defacto complainant with wooden log and caused injury to the defacto complainant. Hence, the case.

3.The learned counsel appearing for the petitioners would submit that the petitioners have not been committed any offence as alleged by the prosecution and the defacto complainant had sustained only simple injuries. Hence, the learned counsel prays to grant anticipatory bail to the petitioners.

4.The learned Government Advocate (Crl.side) would submit that injured person has been discharged from the hospital. He would also submit that there is one previous case pending against the petitioner.

5. Considering the fact that the injured has been discharged from the hospital, this Court is inclined to grant anticipatory bail to the petitioners. 6.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate No.2, Attur, Salem on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that:

State of Kerala [(2005) AIR SCW 5560]; and;

(f)if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
