On perusal of the records, this Court finds that the evidence has already been let in before the trial Court and that the substantial evidence has been taken on record. Therefore, at this stage, this Court is not inclined to allow the present petition.

When this Court was about to dismiss the petition, the learned counsel appearing for the petitioner sought permission of this Court to withdraw the same and also made an endorsement to that effect. 3.

In view of the submission and the endorsement made by the learned counsel appearing for the petitioner, this Criminal Original Petition is dismissed as withdrawn. Consequently, the connected miscellaneous petition is closed.
