ORDER

This Criminal Original Petition has been filed seeking direction to the respondent-Police to conduct further investigation in Cr.No.51/2023 registered under Section 174 of Cr.P.C., and to convert the offence under Section 302 of IPC and to file a final report within the time frame fixed by this Court.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent-Police and perused the materials available on record.

3. With regard to the dispute between the parties, a case and counter had been registered in Crime Nos.1033 and 1034 of 2020 as against both the parties. On a perusal of the records, it appears that on the night of 13.2.2023, the petitioner's son went to sleep. The next day, he was found dead inside the house. The family members had broke open the room and found that he was dead. Hence, complaint in F.I.R.No.51 of 2023 has been lodged on 14.2.2023. 2/6

4. According to the petitioner, his son's death had happened due to previous occurrence said to have been taken place on 22.3.2020. It is the contention of the petitioner that since some of the accused persons are working in the District Police Office, investigation has not been properly conducted in this case. Hence, the petitioner seeks direction to the respondent-Police for further investigation.

5. On a perusal of the records, it is seen that the petitioner now seeks to register a case for the offence under Section 302 IPC., for the alleged death of the petitioner's son. The petitioner's son died on 13.2.2023, when the petitioner's son went to sleep at night in his home. The petitioner's son was found dead in the next morning. It is not the case of the petitioner that some of the accused persons trespassed into his house and caused injury, due to which, the alleged occurrence had happened. The petitioner assumed that death would have been caused due to injuries sustained by the petitioner's son during the earlier occasion which had occurred in the year 2020. It is mere assumption of 3/6

the petitioner that the cause of death of the petitioner's son was due to previous injury caused.

Considering the grievance of the petitioner and also considering the fact that the final report has not yet been filed by the respondent-Police in the earlier cases, this Court is of the view that the Assistant Superintendent of Police, Vettavalam Police Station, Thiruvannamalai is directed to conduct further investigation in both the matters and file a final report before the concerned Court within a period of two months from the date of receipt of a copy of this Order.

7. With the abovesaid direction, this Criminal Original petition is disposed of.
