The petitioner was granted anticipatory bail in the Crl.O.P.No.22424 of 2018 with condition to deposit a sum of Rs.1,00,000/- to the credit of Crime No.307 of 2018 before the learned Judicial Magistrate, Ooty, within a period of two weeks from the date of receipt of copy of the order.
2. Pursuant to the aforesaid order, the petitioner deposited a sum of Rs.1,00,000/- in the Crime Number. However, by an order dated 05.07.2022, the learned Judicial Magistrate closed the FIR as undetected. To that effect, the proceedings issued by the learned Judicial Magistrate is also enclosed.
3. In view of the above, the petitioner is entitled for the amount deposited in the Crime No.307 of 2018. Accordingly, the petitioner is permitted to withdraw the same and the learned Judicial Magistrate is directed to return the amount deposited by the petitioner to the credit of the Crime No.307 of 2018 within a period of two weeks from the date of receipt of copy of this order.
