Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the 2nd respondent and 3rd respondents to dispose the petitioner amount which was deposited in the name of indemnity bond executed by the petitioner at the time of joined under the 3rd respondent by considering the petitioner representation dated 15.06.2016.

ORDER

This Writ Petition has been filed by the petitioner seeking for issuance of a Writ of Mandamus, to direct the respondents 2 and 3 to dispose the petitioner amount which was deposited in the name of indemnity bond executed by the petitioner at the time of joining under the 3rd respondent by considering the petitioner's representation dated 15.06.2016.

The case of the petitioner is that the 1st respondent had called for the post of probationary assistant manager (Generalist) in junior management grade (JMG) Scale - 1 with reference to the selection process conducted by IBPS, Mumbai. Therefore, he had attended the examination and was selected for the said post and thereafter, working Page No.2 of 6

under the 3rd respondent sincerely for a period of 21 days. In the meantime, he has cleared NABARD bank Grade-1 examination. Hence, he received a call letter from the Nabard bank at lucknow, thereby he gave a resignation letter to the respondents 1 to 3 on 22.09.2015, however the 2nd respondent had forced the petitioner to deposit a sum of Rs.2,70,000/- in the petitioner's account before the 3rd respondent. Therefore, without any other option, he deposited the above said amount in his bank account maintained with the 3rd respondent on 05.10.2015. Even after reliving from the bank, the respondents 1 to 3 not disposed his amount to him. Therefore, he made several representations before the respondents 1 to 3 to dispose the said amount to him and the last of which is on 15.06.2025. Since the same was not considered by the respondents 1 to 3, the present writ petition is filed.

3. Though very many grounds have been raised in this writ petition, the learned counsel for the petitioner submits that it would suffice, if this Court issues a direction to the respondents 2 and 3 to dispose the petitioner's amount, which was deposited in the name of Page No.3 of 6

indemnity bond executed by the petitioner at the time of his entry under the 3rd respondent, by considering his representation dated 15.06.2016, within a reasonable time that may be fixed by this Court.

4. The learned counsel for the respondents on instructions submits that this Court may direct the petitioner to send a copy of his representation, enclosing the deposit receipt to the respondents, enabling the respondents 2 and 3 to pass appropriate orders on it, as expeditiously as possible.

In view of the limited request sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the petitioner to send a copy of his representation dated 15.06.2016, enclosing the deposit receipt along with a copy of this order to the respondents, within a period of two (2) weeks from the date of receipt of a copy of this order. Upon receipt of the same, the respondents 2 and 3 are directed to pass appropriate orders on it, on merits and in accordance with law, within a period of four (4) weeks thereafter. Page No.4 of 6

6. With the above directions, this Writ Petition is disposed of. No costs.
