ORDER

This Criminal Original Petition has been filed to call for the records in Crime No.74 of 2025 pending on the file of the Sub Inspector of Police, T5 Vanagaram Police Station and to quash the same.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent-Police and perused the materials available on record.

3. The respondent-Police registered a case as against the petitioner and others in Crime No.74 of 2025 for the offences under Sections 189(2), 115(2), 118(1), 140(3) and 351(3) of BNS. Case and counter have also been filed as against the accused persons. It is the contention of the petitioner that no such offence has been made out as alleged by the respondent Police. Hence, he seeks to quash the said F.I.R.

4. On a perusal of the records more particularly, the F.I.R, it is seen that serious allegation such as kidnapping and causing of injuries are made out. Further it is seen that while granting bail to the accused in the case and counter case vide common order dated 18.7.2025 in Crl.O.P.Nos.16366, 16788, 17321, 17411 & 16876 of 2025, this Court has recorded that it is a fight between two groups with regard to peddling of ganja and seen that the students have been tasted ganja and further this Court ordered to investigate the case.

5. In view of the above and also considering the serious nature of offence, this Court is not inclined to quash the F.I.R at this stage. Accordingly, this Criminal Original Petition is dismissed.
