This Civil Miscellaneous Petition has been filed to condone the delay of 229 days in filing the above appeal.

2. Heard the learned counsel for the petitioners.

3. Mr.P.Suresh Srinivasan, learned counsel takes notice for the 3rd respondent and he has got objection in allowing the application.

4. The first petitioner would aver that, on account of the accident, her husband died and due to financial constraints, she was not in a position to prefer an appeal. Hence, a delay of 229 days occurred in filing the appeal.

5. Accepting the averments made by the petitioners, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 229 days shall stand waived. Accordingly, this Civil Miscellaneous Petition is ordered.
