ORDER
The petitioner, who was arrested and remanded to judicial custody on 15.07.2025 for the alleged offence under Section 296(b), 311, 324 (4), 351(3) of BNS in Crime No.618 of 2025 on the file of the respondent police, seeks bail.
2. The case of prosecution is that on 15.07.2025 the petitioner/accused abused the defacto complainant in filthy language and robbed a sum of Rs.2,000/- from him and attacked him with liquor bottle. Hence, the complaint was registered against the petitioner.

The learned counsel appearing for petitioner submitted that this is the second petition seeking for bail and the entire allegation is false, vindictive, wanton and he is no way connected with the offence. He would submit that he has not at all committed any of offence as alleged by the respondent police and he has been falsely implicated in this case and he will abide by any condition that may be imposed by this court. He would submit that the investigation almost completed and that the petitioner has been suffering incarceration for more than 41 days from 15.07.2025. Hence, he prayed to grant bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that as per the complaint, the petitioner had abused 2/4
him and robbed Rs.3000/- from the defacto complainant and there are 22 previous cases pending against him and he is an history sheeter. He would submit that that if he is released on bail, he would tamper the witnesses and hamper the investigation and the investigation is almost completed. Hence, he vehemently opposed to grant bail to the petitioner.

Considering the facts and circumstances of the case and the submissions made by both counsel and also considering gravity of offences committed by the petitioner, he is having 22 previous cases, investigation is not yet completed, he is an history sheeter and if he is released on bail, there is possibility of tampering the witnesses and hampering the investigation and also the fact there is no change of circumstances, this Court is not inclined to grant bail to the petitioner.
