The learned Government Advocate (Crl.Side) appearing for the respondent police opposed the grant of bail to the petitioner and submitted that several other accused are also absconding and Non-Bailable Warrants are pending against them, which has hindered the progress of a case pending since 2022. He further submitted that the trial Court has recorded that this petitioner is habitual absentee and therefore, the NBW was issued and executed. 3.

Considering the nature of the crime and the petitioner's chronic absence from trial proceedings, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed for the present.
