Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 2nd respondent to entertain and register the petitioner's Memorandum of Deposit of Title Deeds in respect of Plot No.13, comprised in Survey No.89/12, measuring 1100 sq.ft., at Sri Ram Garden, Krishnapuram Village, Thadaperumbakkam-I Group, Ponneri Taluk, Thiruvallur District. ORDER
Mr.Abishek Murthy, learned Government Advocate takes notice on behalf of the respondents 1 and 2. Mr.K.Karthikeyan, learned Government Advocate (HR & CE), takes notice on behalf of the 3rd respondent. With consent, the main Writ Petition is taken up for final disposal at the stage of admission itself.
2. This Writ Petition has been filed seeking to direct the 2nd respondent to entertain and register the petitioner's Memorandum of 2/6
Deposit of Title Deeds in respect of Plot No.13, comprised in Survey No.89/12, measuring 1100 sq.ft., at Sri Ram Garden, Krishnapuram Village, Thadaperumbakkam-I Group, Ponneri Taluk, Thiruvallur District.
3. The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the aforesaid property which was pruchased under a registered Sale Deed dated 07.10.2020. After purchase of the aforementioned property, the petitioner availed a housing loan of Rs.27,60,000/-from TANGEDCO and deposited the original title deeds with his employer. For creating mortgage, the petitioner prepared a Memorandum of Deposit ot Title Deeds and presented it for registration before the 2nd respondent/Sub Registrar, Ponneri. However, the said authority refused to register the same citing the objections raised by the Executive Officer of Arulmugu Karikrishna Perumal Koil. Further, he would submit that when similar objection was raised in an another case in which the petitioner's survey number was included and when the same was challenged by one E.Suresh before this Court in 3/6
W.P.No.2563 of 2025 this Court vide order dated 31.01.2025 directed the Sub Registrat to register the document produced by the petitioner therein. He therefore prays for a direction to the 2nd respondent to entertain and register the petitioner's Memorandum of Deposit of Title Deeds.
4. The learned Government Advocate appearing for the respondents 1 and 2 would submit that the appeal has been preferrred against the aforesaid order and the same is pending. Further, he would submit that Memorandum of Deposit of Title Deeds was not presented before the 2nd respondent as contended by the learned counsel for the petitioner and if such document is produced, the 2nd respondent after conducting the enquiry, in case of any objection, shall take decision whether to register the same or not.
5. Considering the facts and circumstances of the case and also upon the submissions made, it is open to the petitioner to produce the Memorandum of Deposit of Title Deeds before the 2nd respondent and if 4/6
the said document is produced, the 2nd respondent shall register the same if there is no objection from any of the parties. In case of any objections,the respondent is at liberty to conduct the enquiry and proceed in accordance with law.
6. With the above directions, this writ petition is disposed of. No costs.
