ORDER

Ms.Nithya, the learned counsel appearing for the petitioner submitted that the wife has filed D.V.C.No.14 of 2025 before the Judicial Magistrate Court at Vandavasi. She further submitted that the respondent/wife suppressed the material facts and filed the Tr.C.M.P.No.714 of 2024.

I had gone through the affidavit filed in respect of Tr.C.M.P.714 of 2024 and allowed the transfer petition. No doubt on the said day, when the Tr.C.M.P., was taken up for orders, there was no appearance by the review applicant on that day. 3.

I have also gone through an affidavit in support of the review application as well as the petition filed under Section 13(1)(ia) of the Hindu Marriage Act. The petitioner in Tr.C.M.P., has made out good grounds for seeking transfer of the proceedings on the file of V Additional Family Court, Chennai to Sub Court, Vandavasi. I do not see any strong reason to recall the said order, on the basis of the objections now raised for in the Tr.C.M.P.

The review applicant is at liberty to engage a counsel of his choice to appear on his behalf before the Sub-Court, Vandavasi. It is made clear that the review applicant need not appear on all hearing dates and would be sufficient if he appears physically, only on the relevant dates when his evidence is recorded in chief and cross. Liberty is also granted to him to seek dispensing with his appearance in the D.V., proceedings , by filing an appropriate application. 2/4

The H.M.O.P., was filed in November 2023 and hence, the Sub Court, Vandavasi shall ensure that pleadings are completed within a period of four weeks. The case papers shall be transmitted from the V Additional Family Court, Chennai to Sub Court, Vandavasi and the Sub Court shall endeavour to dispose of the matter expeditiously, preferably within a period of six months thereafter.
