ORDER

(Order of the Court was made by S.M.Subramaniam J.) The present contempt petition has been instituted to punish the respondents for their willful disobedience of the interim order dated 24.06.2025 passed in WA.No.1860 of 2025.

2. Learned counsel for the petitioner would submit that the interim order passed by this Court has not been complied with.

3. Per-contra, learned Government Advocate would furnish the copy of another interim order passed by the Division Bench of this Court on 26.09.2025 in W.A.No. 2917 of 2025 and paragraph 3 of the order reads as under, "...

3. Among the two, who is eligible to get such appointment as P.G.Assistant (Commerce) in the fourth respondent School can be decided at later point of time at the final hearing of the writ appeals, but in the meanwhile, in order to avoid hindrance for the students' studies at the School, we hereby direct

the fourth respondent School Management to engage both the appellant as well as the fifth respondent as both are qualified to hold the post of P.G.Assistant (Commerce) to take classes for the students concerned in the Commerce Subject until further orders. It is made clear that, merely because these two teachers are drawn for taking classes as P.G.Assistant (Commerce) subject, that would not ipso facto confer any right on them to claim appointment and approval of such post in future as that would be decided only on the basis of the merits at the final hearing of both the writ appeals."

4. Pertinently, both these writ appeals have been instituted by the contempt petitioner herein, namely Kavitha. As far as the subsequent order of the Division Bench dated 26.09.2025 is concerned, both writ appeals have been tagged, and the Court has directed to list the matters for consideration.

5. In view of this, petitioner has to seek for further hearing. However, this Court does not find any willful disobedience of the order of the Court warranting initiation of action for contempt of Court.

6. Registry is directed to list both the writ appeals viz., WA.No.1860 of 2025 and WA.No.2917 of 2025 before the Bench holding roster.

7. With the above observation, the contempt petition stands closed. No costs.
