Crl.M.P.No. 17929 of 2023 in Crl.O.P.No.15332 of 2023 A.D.JAGADISH CHANDIRA, J., This petition has been filed seeking to grant a further period of five months to complete the investigation and to file the final report as per direction of this Court in Crl.O.P.No.15332 of 2023, dated 10.07.2023.
2. Mr. C.E.Pratap,learned Government Advocate(Crl.side) appearing for the petitioner/respondent police would submit that based on the complaint given by one Shankar, the petitioner/respondent police have registered a case in Crime No.1 of 2022 against two accused for the offences under Sections 409, 109 of IPC and Section 13(2) r/w. 13(1)(c) of Prevention of Corruption Act 1988 on 07.03.2022. Thereafter, the defacto complainant had approached this Court in Crl.O.P.No.15332 of 2023 seeking for a direction to complete the investigation and file a final report and this Court, by an order dated 10.07.2023, had directed the petitioner/respondent police to expedite the investigation and complete it within a period of two months from the date of receipt of a copy of the order and file final report.

He would further submit that one Mr.P.Anbalagan, Inspector of Police, Vigilance and Anti-Corruption, Cuddalore, is the Investigating Officer and he received the said copy of the order only on 21.08.2023. However, he had completed the investigation and the files had been sent to the respective Superior Officers of the accused for obtaining appropriate sanction and thereby, there had been a delay in filing the final https://www.mhc.tn.gov.in/judis
A.D.JAGADISH CHANDIRA, J., mrp report. Mr.P.Anbalagan, Inspector of Police, has also filed an affidavit in respect of the same. He would also submit that the petitioner/respondent police has conducted investigation earnestly in compliance of the order of this Court and that there had been a delay of two weeks and thereby, the present petition has been filed seeking for extension of time.
5. The affidavit of Mr.P.Anbalagan, Inspector of Police, has been perused and taken on record.

Taking into consideration the submission made by the learned Government Advocate(Crl.side) appearing for the petitioner/respondent police and the affidavit filed by Mr.P.Anbalagan, Investigating Officer, time granted in Crl.O.P.No.15332 of 2023, dated 10.07.2023 is extended for a further period of three months from today and the petition stands ordered accordingly.
