The petitioner herein was arrested on 04.08.2025 based on the complaint given by the defacto complainant alleging that this petitioner had 1/3
promised to marry her and indulged in sexual relationship. After she getting conceived, the petitioner had forced her to abort the fetus and refused to marry her. Hence the offence under Section 69 of BNS, 2023. 2.The learned counsel for the petitioner states that the petitioner is no way connected with the alleged offence and to intimidate the petitioner, the present complaint being filed.
3.However, this Court, on perusing the statement of the victim girl as well as the other documents, finds that the ingredients of Section 69 of the BNS Act, 2023 are clearly made out.
4.The learned Government Advocate (Crl. Side) appearing for the respondent states that the prosecution has completed the investigation and filed final report.
5.In the said circumstances, till the victim girl is examined, the petitioner to be in custody or else there is every possibility of extorting the evidence. Hence, this bail petition stands dismissed. 03.09.2025 smv 2/3
