Respondent(s) PRAYER; This writ petition has been filed under Article 226 of Constitution of India, directing the 1st respondent and 2nd Respondent to issue passport in Application No.ARN. 25- 1001870969 by the petitioner, to a child by name J.Ayaan Yahya was born through the wedlock of the petitioner and her 2nd Husband on 03.05.2023.

ORDER

This writ petition has been filed seeking a direction to the 1st respondent and 2nd Respondent to issue passport in Application No.ARN. 251001870969 by the petitioner, to a child by name J.Ayaan Yahya was born through the wedlock of the petitioner and her 2nd Husband on 03.05.2023.

2. It is the case of the petitioner that her son by name Master J.Ayaan Yahya who is a two years old baby, seeks passport to go Mecca as a Pilgrimage. The petitioner has got married to Lukmanul Hakkim on 05.05.2016. The marriage did not last long and they lived only three months. On 18.12.2020 they got separated by way of Kula. Based upon that the marriage was dissolved. When the petitioner applied for passport for her son, the officer in the counter declined to issue the passport for her son. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may issue a direction to the respondents 1 & 2 to issue passport for the petitioner's son as she has booked the ticket on 17.09.2025 for holy trip to Mecca.

4. The learned counsel appearing for the respondents 1 & 2 submits that the application of the petitioner will be considered within the stipulated time as fixed by this Court.

5. Heard the learned counsel for the petitioner and the learned Government Counsel appearing for the respondents and perused the materials available on record.

6. Considering the fact that the child could not visit the Mecca without passport and also considering the limited request sought for by the petitioner, this Court directs the respondents 1 & 2 to issue passport to the petitioner's son on or before 15.09.2025 to visit the ''Mecca'' for the limited period.
