The petitioner who was arrested and remanded to judicial custody on 25.05.2022 for the offence punishable under Sections 8(c), r/w 20(b)(ii)(C) of NDPS Act in Cr.No.23 of 2022, seeks bail.
2. The case of the prosecution is that the petitioner was in possession of ganja of 20 kg and 100 grams, which is of commercial quantity. Hence the complaint.
3.The learned counsel for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence prays for grant of bail.
4.The learned Government Advocate (Crl.Side) would submit that this is the second bail petition and the earlier petition has been dismissed by this Court in Crl.O.P.No.23345 of 2022 He further submits https://www.mhc.tn.gov.in/judis

smn that the petitioner is a habitual offender and having 4 previous cases. Therefore, if the petitioner is released on bail, there is a possibility of absconding. Hence, he vehemently opposed to grant bail to the petitioner.
5. Considering the facts and circumstances of the case and there are four previous cases pending against the petitioner, this court is not inclined to grant bail to the petitioner.
