in Crl.O.P.No.27350 of 2022 T.V.THAMILSELVI.J., This Petition has been filed to modify the condition imposed on the petitioner vide order dated 17.11.2022 in Crl.O.P.No.27350 of 2022 in para No. 9 which is as follows:

"9. Accordingly, the petitioner is ordered to be released on bail on condition to make non refundable deposit of Rs.25,000/- ( Rupees Twenty Five Thousand only) by way of Demand Draft/RTGS/NEFT to the " The Dean/Medical Officer, Government Mohan Kumaramangalam Medical College Hospital, Salem," without prejudice to his rights and contentions before the Trial Court, on such deposit and production of proof the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- ( Rupees Twenty Five Thousand only) with two sureties ( out of which one surety should be blood related sureties and should produce document to show his/ her means), each for a like sum to the satisfaction of the learned Special Judge for EC/NDPS Act cases, Salem and on further condition that". 1/3

2. The learned counsel for the petitioner would submit that the sureties have no property, hence the petitioner is not in position to execute the bail bond Hence he seeks modification of the said condition.

3. In view of the above, the condition imposed by this Court in Crl.O.P.No.27350 of 2022 in para No. 9 dated 17.11.2022 is modified to the effect that the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- ( Rupees Twenty Five Thousand only) with two sureties out of which one surety should be blood related surety each for a like sum to the satisfaction of the learned Special Judge for EC/NDPS Act cases, Salem and two weeks time is granted to the petitioner to surrender and execute sureties before the concerned Magistrate as imposed by this Court, from the date on which the order copy made ready. Failing which, the petition for anticipatory bail shall stand automatically dismissed.
