ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. The case was registered in Cr.No.1284 of 2015 dated 06.04.2015 for the alleged offence under Section 379 of Indian Penal Code, 1860. The occurrence in this case happened on 05.04.2015. The complainant is present and submits that his two wheeler bearing Registration No. TN-20-BP-0185 Page No.1 of 3

has been returned to him. It is submitted that the defacto Complainant has been paralized and hence he does not wish to pursue the case any further. The case is pending at the stage of FS.

3. Considering the long pendency, the complainant's stand and the fact that the accused remains untraceable, further continuation would impinge upon the right to a speedy trial. No useful purpose will be served by keeping the matter pending.

4. Accordingly, the case in CC.No.702/2016 on the file of the XXIII Metropolitan Magistrate Court, Saidapet Taluk, Chennai shall stand quashed and this Suo Motu Transfer Case stand disposed of. 24.09.2025 shl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
