The petitioner, who was arrested and remanded to judicial custody on 01.06.2022 for the alleged offence under Sections 147, 148, 341, 302 r/w 149 of I.P.C. in Crime No.839 of 2020 on the file of the respondent police, pending trial in S.C.No.211 of 2022 on the file of learned Addl. Sessions and City Civil Court, Chennai, seeks bail.
2. It is a case of jumped bail. The petitioner was arrested on 01.06.2022 pursuant to the non-bailable warrant issued against him.

The learned counsel appearing for petitioner would submit that the petitioner name was not found in the F.I.R. and when the case is posted for hearing during Covid period, he unable to attend the court on the date of hearing i.e. on 29.07.2021, the learned Judge ordered non-bailable warrant against the petitioner, thereby he was detained under PT warrant on 01.06.2022 on execution of non-bailable warrant. He would submit that he is in jail from 01.06.2022. Hence, he prayed to grant bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that totally, there are 8 accused and the petitoner
is arrayed as A1. He would submit that the petitioner is absconding for more than one year and thereafter, after hectic efforts, he was secured only on 01.06.2022. He would further submit that totally, there are 17 previous cases including four numbers of Sec. 307 cases and he is the prime accused involved in the offence. He would submit that after securing him only, the S.C. Number was assigned and now the witnesses have to be examined. Hence, if he is released on bail, there is possibility of hampering the investigation. Therefore, he vehemently opposed to grant bail to the petitioner.

Considering the facts and circumstances of the case and the fact that after one year, he was secured and now the case is at the stage of examining witnesses and there are 17 previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 13.12.2022 rpp
