No.618 of 2025.

2. The case in C.C.No. 101 of 2020 was taken on the file of the Judicial Magistrate No.2, Erode Taluk, Erode for the alleged offence under Section 379 of I.P.C. The accused committed theft of complainant's mobile. It is reported that the property involved in this case has been recovered and returned to the complainant and the de-facto complainant has no objection for closing the case. Insofar as the split up case in respect of other accused is concerned, it was proceeded further and they were convicted and they undergone the sentence and came out. As far as this case is concerned, warrant is pending against the accused.

Suo Motu TR.No. 7741 of 2025 3.Considering the factual matrix, context of the case, the reason for absence from his usual place, and the submission that, despite best efforts, the warrant could not be executed, it is evident that even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.

4.Accordingly, the case in C.C.No.101 of 2020 of Judicial Magistrate No.2, Erode Taluk, Erode, stands quashed. These Suo Motu Transfer Cases are disposed of.

10.10.2025 mp electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
