The petitioner seeks anticipatory bail in Crime No.289 of 2023, registered under Sections 392, 506 (ii) IPC and Sections 3(2)(a), 4(2)(a), 4(2)(c), 5(1)(d) of Immoral Traffic (Prevention) Act, 1956. 2.It is the case of the prosecution that the defacto complainant had lodged a complaint stating that on 06.10.2023, when he was near Ratnapura Lakshmipuram Mint bakery, three men and one woman were standing there and they had called him over and later, he went with them to Hotel Snow Drop Lodge at Lakshmipuram 3rd street. It is stated that this petitioner was running the lodge on monthly rental and was conducting prostitution. The defacto complainant then narrated the incident which had happened in the lodge to the police and FIR was registered.

3.The learned counsel for the petitioner states that the petitioner has nothing to do with that particular lodge, but he is running another lodge, by name Hotel Grand Castle. It is stated that the respondent have

deliberately foisted the case against him.

4.However, it is the case of the respondent that the name of the petitioner is found in the FIR and that the petitioner is running the lodge on lease, wherein, the defacto complainant was taken. 5.These are the issues which will have to be investigated. Anticipatory bail therefore cannot be granted. Accordingly, this Criminal Original Petition is dismissed.
