ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered in Cr.No.391 of 2014 for the alleged offences under Section 379 of the I.P.C. The allegation in this case is that the accused committed theft of the bike of the defacto complainant. It is reported that the said bike has been recovered and is in the custody of the Court as the same was not handed over to the default complaint because he doesn't possess the Registration Certificate (RC) book of the said bike. 3. It can be seen that there is no other claim for the bike and also the bike need not rot in the custody. The defacto complainant is objecting for quashing of the case only on the ground that the vehicle is not received by him.

4. Under the set circumstances, the custody of the bike shall be handed over to the defacto complainant on condition that he will apply for the duplicate of the RC book of the said bike and obtain the same from the authorities in accordance with law. With the said undertaking, the bike shall be handed over to the defacto complainant, who shall take steps to get the duplicate of the RC book of the bike within a period of two (2) months from the date of handing over of the bike to him. There is no previous or subsequent case against the accused.

5.Against A1, NBW is pending and A2 is facing the trial since 2014. Considering the nature of the allegation, the antecedents of the accused, any further continuation of the trial would impinge upon his right to a speedy trial of the accused and no useful purpose would be served. Page No.2 of 4

6.Accordingly, the case in C.C.No.100172 of 2014 of Judicial Magistrate Court No.1, Mannargudi Taluk, Tiruvarur, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
