The petitioner, who was arrested and remanded to judicial custody on 03.10.2024 for the offences under Sections 174(3) altered into 304(b) of I.P.C in Crime No.193 of 2024 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the deceased married the petitioner in the year 2020 and there was dowry harassment in the matrimonial house, due to which the deceased was living in her parents house. Whileso, on 22.03.2024 the deceased committed suicide. Hence, the respondent police has registered a case against the petitioner.
3. Learned counsel for the petitioner submitted that the petitioner is an innocent person, he has not committed any offence as alleged by the prosecution, and he has been falsely implicated in this case. He would further submit that the petitioner is arrested and is in judicial custody from 03.10.2024 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed bail for the petitioner.
4. Learned Government Advocate (Crl.Side) opposes the grant of bail to the petitioner by stating that due to the dowry harassment made by the petitioner's family the deceased committed suicide. He further submitted that there are two previous case pending against the petitioner.
4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) and perused the materials available on record.
5. Considering the submissions made by the learned counsel on either side, considering the fact that the investigation in this case has not been completed and also considering the grave nature of the offence and also considering all the above factors, I am not inclined to grant bail to the petitioners at this stage. Accordingly, this Criminal Original Petition is dismissed.
