This application has been filed seeking for appointment of Advocate Commissioner to record the evidence of applicant/plaintiff at home at Old No.7, New No.14, 2nd Main Road, Ram Nagar, Peravallur, Chennai - 600 082.

2. It is the case of the applicant that she has set back in health and aged about 80 years, therefore, she seeks appointment of Advocate Commissioner to record the evidence.

3. Heard both sides and there is no serious objection on the side of the respondent/defendant. Considering the fact that the plaintiff has set back in health and there is no objection on the side of the respondent, this Court is of the view that she evidence of the applicant/plaintiff can be recorded through the Advocate Commissioner.

4. By consent of both sides, this Court appoints, M/s.R.GHANDHIMADHU, No.5/174, Anbazhagan Street, Mondiamman Nagar, Redhills, Chennai - 600 052, Mobile No.99520 81601 is appointed as an advocate commissioner for recording evidence of the applicant/plaintiff. The remuneration to the Advocate Commissioner is fixed at Rs.30,000/- and the same shall be paid by the plaintiff directly to the Advocate Commissioner. The Advocate Commissioner shall inform the dates of examination to both sides and after getting convenient time from both sides, she shall record and complete the evidence at the plaintiff's residence at Old No.7, New No.14, 2nd Main Road, Ram Nagar, Peravallur, Chennai - 600 082.

5. The evidence of applicant/plaintiff shall be completed before 04.12.2023 and file the evidence of the witness along with the Advocate Commissioner's report, before this Court, on 04.12.2023. Registry is directed to handover all the documents to the advocate commissioner in a sealed cover.
